Model Jaminan Prosedural Penertiban Nonyustisial oleh Satuan Polisi Pamong Praja Kota Batam: Studi Penelitian Hukum dengan Metode Modified Delphi

Penelitian ini bertujuan merumuskan model jaminan prosedural penertiban nonyustisial oleh satuan polisi pamong praja (Satpol PP) Kota Batam. Permasalahan penelitian belum tersedianya standar terintegrasi yang menghubungkan legalitas, diskresi, proporsionalitas, dokumentasi, pengaduan dan akuntabilitas dalam tindakan penertiban administratif. Penelitian menggunakan metode Modified Delphi dua putaran dengan melibatkan 16 panel yang terdiri atas unsur Satpol PP, PPNS dan bagian hukum pemerintah daerah, akademisi, praktisi dan perlindungan hak, perwakilan masyarakat dan pelaku usaha. Instrumen mencakup 36 indikator dalam delapan dimensi. Data dianalisis menggunakan median, interquartile range, persentase persetujuan, Kendall’s Coefficient of Concordance dan analisis tematik terhadap komentar panel. Hasil putaran pertama menunjukkan 22 indikator diterima, 11 direvisi dan tiga dihapus. Putaran kedua menghasilkan 32 indikator final dalam delapan dimensi. Konsensus tertinggi terdapat pada legalitas dan batas kewenangan serta proporsionalitas dan tahapan eskalasi. Nilai Kendall’s W sebesar 0,72 dengan p < 0,001 menunjukkan keselarasan panel yang kuat. Penelitian menyimpulkan penertiban nonyustisial yang sah dan akuntabel harus didasarkan pada verifikasi pelanggaran, pembatasan kewenangan, kesempatan koreksi sukarela, eskalasi bertahap, dokumentasi keputusan, supervisi, mekanisme pengaduan dan pemulihan. Model memberikan kontribusi teoretis dengan mengintegrasikan administrative justice, birokrasi garis depan dan responsive regulation, sekaligus menyediakan kerangka praktis bagi penyempurnaan tata kelola penertiban Satpol PP
